Terms and Conditions JobsBoard
Terms and Conditions Jobs Board is a Nevada based company organized under the laws of Nevada, operating as a subsidiary of Suite Business Solutions with principal offices in Mesa, Arizona and hereinafter referred to as JobsBoard and agrees to provide an online marketplace for caregivers and services under the following terms and conditions.
General Provisions
These Terms and Conditions, along with the Privacy Policy, are the entire agreement between (“HireMyCare”) and you (“Care Seeker,” “Caregiver,” “Vendor” and/or any other “Customer” or “User”). For purposes of these Terms and Conditions, JobsBoard means and includes JobsBoard and its affiliates, subsidiaries, investors, officers, directors, employees, agents, representatives and assigns.

This agreement supersedes any prior agreement between the Users and JobsBoard, Suite Business Services, LLC and their affiliated parties. If any provision of these Terms and Conditions is held unenforceable, then said provision will be modified according to standard practices and laws and all remaining provisions of these Terms and Conditions shall remain in full force and effect.

Acceptance of Agreement
By clicking “I Agree” and thereby accessing, viewing, and/or using the Site/Service, you understand and agree to be bound by all terms and conditions outlined in this document, along with the Privacy Policy.

In addition, by accessing the Site/Service, you consent to receive this agreement in an electronic format.

Users agree to release JobsBoard and all JobsBoard affiliated parties, including but not limited to Suite Business Services, LLC and Acumen Fiscal Agent, LLC, from any and all claims regarding any misstatements and misrepresentations made by any Users of the Site/Service.

Service and Definitions is a venue that provides an online marketplace environment for people seeking household caregiver and goods/services (“Care Seekers”) to connect with individuals who can be household employees (“Caregivers”) and businesses that provide goods/services (“Vendors” or “Product/Service Providers”). is not a referral or matching service and does not offer or seek to endorse any particular caregiver or vendor service, nor does make any guarantee of employment or sales to Caregivers or Vendors. For the purposes of this agreement, “Customer” or “User” is understood as any site user. does not screen or verify the identity, background, training, experience, or longevity of those individuals or entities providing goods/services of any of the Users. also does not screen or monitor content submitted by Users, including, but not limited to, profiles, ratings and testimonials. As a result, has no control over the accuracy, reliability, completeness, or timeliness of the content on the Site/Service. makes no representations concerning any of the content or Users on the Site/Service. It is the User’s responsibility to make his or her own assessment of the people and businesses the User decides to interact with, engage, receive services from, or provide services for.

Transactions occurring on or because of are solely between the Users of the Site/Service. and Suite Business Services, LLC are not involved in the transactions between any Users. is not party to any payment arrangements, as Users are responsible for arranging for payment of goods and services solely between themselves. is not an employer of any User.

Users must resolve any issues, disputes or concerns directly with each other, including any issues regarding payment, and must not involve in said disputes. By selecting “I agree” when Users register, they are releasing from any claims or liability that may arise from any issues, disputes or concerns between Users with any payment liabilities or any other liabilities pertaining to services offered by any User.

User Eligibility
Users of attest that they are at least the legal age to work or represent themselves in the state in which they reside. Caregivers and Vendors attest that they have the legal right to work and provide services in the state in which they reside. JobsBoard expressly disclaims, and each Customer expressly releases JobsBoard from, any and all liability whatsoever for any controversies, claims, suits, injuries and/or damages, arising from and/or in any way related to any misrepresentations regarding the age of any Customer. Users of attest that they:

  • Have never been convicted of, or are currently pending trial for, a felony, any criminal offense involving violence, abuse neglect, fraud, larceny or any other offense that involves endangering the safety of others.


  • Have never been, or are currently not required to, register as a sex offender with any government entity, including local, state and federal. does not conduct background checks on its Users. However, other Users have the right to verify the representations and warranties being made, which may include, without limitation, conducting background checks on each other or companies and researching other Users or companies using public records and agencies, such as, but not limited to, the List of Excluded Individuals/Entities (LEIE) database and the Better Business Bureau (BBB).

Customer hereby agrees to report any alleged improprieties of any Users to JobsBoard immediately by emailing [email protected]. JobsBoard reserves the right to suspend and/or terminate with or without notice the membership of any Customer whom it believes to have been provided false information when registering for and/or using the Site/Service, and each Customer agrees to make no further use of the Site/Service after termination and/or during suspension.

Registration, Account Information and Account Security
When registering to use the Site/Service, Users will be asked to create an account and provide certain information about themselves, the person needing services or their company. This information will be used in accordance with JobsBoard‘s Privacy Policy. Users are responsible for providing accurate, current and complete information in connection with their account and registration. Users are responsible for maintaining the confidentiality of their username, password, and account information. Users are solely responsible for all activities that occur to their account. Users agree to immediately notify JobsBoard of any unauthorized use of their account or any other breach of security.

When Users subscribe to a membership with JobsBoard, they may have access to other Users’ personal information. By agreeing to these Terms and Conditions, Users agree not to use other Users’ personal information for purposes other than connecting Users to Caregivers and Vendors.

Personal Use Account Versus Corporate Account
Personal Use Account
Personal Use Accounts, such as Employer and Employee accounts, are for personal use only and not to be shared with others. JobsBoard is intended to be used by people looking for household employees, goods/service providers, a job as a caregiver, or to advertise their goods/services. Any use of for any other purpose is strictly prohibited.

Corporate Account
Vendors and companies wishing to hire caregivers, such as agency providers, are only permitted to use a JobsBoard Corporate Account. Poaching is not permitted. Agency providers caught poaching will be banned from JobsBoard and reported to their state’s human services agencies.

Prohibited Uses
Users are prohibited from violating or attempting to violate any security features of JobsBoard, including, without limitation, (a) accessing content or data not intended for them, or logging onto a server or account that they are not authorized to access; (b) attempting to probe, scan or test the vulnerability of the Site/Service, or to breach security or authentication measures without proper authorization; (c) interfering or attempting to interfere with service to any User, host, or network, including, without limitation, by means of malware, overloading, “flooding,” “spamming,” “mail bombing,” or “crashing;” (d) using the Site/Service to send unsolicited email, including, without limitation, promotions, or advertisements for products or services; (e) forging any TCP/IP packet header or any part of the header information in any email or in any posting using the services; or (f) attempting to modify, reverse-engineer, decompile, disassemble, or otherwise reduce or attempt to reduce to a human-perceivable form any of the source code used by JobsBoard in providing the Site/Service. Customer shall not use customer information in order to contact, advertise, solicit, or sell to any other Customer without their express consent. Customer may not collect customer information or any other information, materials or content on the Site/Service, including without limitation names, phone numbers, email addresses, profiles, copyrighted text, or job listings, or otherwise misuse or misappropriate Site/Service information, materials or content, using manual or automated means without express written permission from JobsBoard. Should JobsBoard have a reasonable basis to believe that Customer violated this section, JobsBoard reserves the right, in addition to other remedies and at its sole discretion, to assess a $XX,XXX daily penalty fee for Web scraping and/or recruiting.

Modifications JobsBoard reserves the right, at any time, to modify its Terms and Conditions. Modifications will be posted to as they become effective, and at such time the Customer’s use of the Site/Service constitutes acceptance of these terms.
Risk Assumption and Precautions
Users assume all risk when using JobsBoard, including but not limited to all of the risks associated with any online or offline interaction with others. Users agree to take all necessary precautions when meeting other Users offline.

Privacy Policy JobsBoard’s Privacy Policy, is occasionally modified by JobsBoard, is a part of these Terms and Conditions and is incorporated herein by this reference. By using the Site/Service, the Customer understands and agrees that the Customer has reviewed and agrees to the Privacy Policy. For more information, view our Privacy Policy here.
Suspension and Termination of Use JobsBoard may, in its sole discretion, for any reason or no reason, with or without notice terminate or suspend User accounts and their access to the Site/Service, remove User profiles and/or any content posted by or about Users from the Site/Service without refund to the User. Following any termination of any User’s account, JobsBoard may send a notice of the termination to other Users the terminated User has corresponded with. If a User’s account has been terminated by JobsBoard, the User may not re-register without JobsBoard‘s consent.

Users may cancel their account at any time by contacting administrators at JobsBoard by emailing us at [email protected].
Governing Law
Arizona law governs the Terms and Conditions for JobsBoard as well as any claims, causes of action or disputes that may arise between the Users of the Site/Service and JobsBoard, without regard to conflict of provisions of the law. Users agree and consent to the exclusive jurisdiction and venue of the state and federal courts of the State of Arizona, County of Maricopa and City of Mesa, and hereby submit to the jurisdiction thereof, for any and all causes of action that they may bring JobsBoard. Notwithstanding the foregoing, JobsBoard shall have the right to bring proceedings in any other court having jurisdiction where Customer is resident from time to time in order to enforce these Terms and Conditions.

Independent Parties
Customer’s use of the Site/Service and/or information in these Terms and Conditions do not make the customer legally affiliated with JobsBoard in any way. The customer is in no way an independent contractor, partnership, joint venture, agent, legal representative, employer-employee or franchiser-franchisee relationship with JobsBoard. Conversely, JobsBoard is in no way an independent contractor, partnership, joint venture, agent, legal representative, employer-employee or franchiser-franchisee relationship with the Customer. As such, Customer shall not have, or hold out to any third party as having, any authority to make any statements, representations or commitments of any kind, or to take any action, that shall be binding on JobsBoard, except as provided herein or authorized in writing by JobsBoard. JobsBoardis not an employment service or agency, does not serve as an employer of the Customer or Employee and does not recruit Customers/Employees for employment, secure employment for Customers or evaluate or test Customers for employment purposes.
Phone Support Services
Phone Support Services, including telephone communications with JobsBoard and the subsequent receipt, acceptance and/or use of information in connection with Phone Support Services, are subject to these Terms and Conditions, and each use of Phone Support Services, including telephone communications with JobsBoard and the subsequent receipt, acceptance and/or use of information in connection with Phone Support Services, also constitutes a use of the Site/Service subject to these Terms and Conditions. JobsBoard provides Phone Support Services for informational purposes only and does not deliver any professional advice, direction or guidance. Customer further understands and agrees that fees paid in connection with the Phone Support Services, if any, is for the delivery of information only and not for any advice, direction or guidance. Customer’s receipt, acceptance and/or use of any information in connection with Phone Support Services is Customer’s further express understanding and agreement to be bound by these Terms and Conditions, including without limitation all limitations, releases and indemnities in these Terms and Conditions. Customer further understands and agrees that any transaction with another Customer following the receipt, acceptance and/or use of information is a transaction between Customers and not with JobsBoard. If Customer uses Phone Support Services, then Customer expressly agrees to release JobsBoard, and JobsBoard hereby expressly disclaims, any and all liability whatsoever for any controversies, claims, suits, injuries and/or damages arising from and/or in any way related to the use of Phone Support Services, including without limitation the receipt, acceptance and/or use of information in connection with Phone Support Services.
Use of the Site/Service
Users of JobsBoard are able to post and transmit information, such as profile information, rate other Users and send messages to other Users. Users are responsible for the content they post and transmit to other Users. Once content has been shared, Users may not be able to withdraw it.

Users are not permitted to post on JobsBoard; transmit to other Users; communicate any content, including links to other sites; or engage in activity on the Site/Service that:

  • Contains other Users’ (people and companies) copyrighted or trademarked content or information without written permission from the owner of said information
  • Contains or discloses another person’s personal information without his or her written permission, or collects or solicits another person’s personal information for commercial or unlawful purposes
  • Implies that the User Content is in any way endorsed or sponsored by JobsBoard
  • Is implicitly or explicitly offensive, such as user content that engages in, endorses or promotes racism, bigotry, discrimination, pornography, hatred or physical harm of any kind
  • Is incomplete, false, misleading, illegal, defamatory, inaccurate, abusive, obscene, profane, sexually oriented, or otherwise objectionable
  • Is intended to harass, annoy, threaten or intimidate any other Users of the Site/Service
  • Involves the transmission of junk mail, chain letters, or unsolicited mass mailing or spamming, phishing, trolling or other similar activities
  • Contains any malware, including but not limited to, viruses, time bombs, trojan horses, cancelbots, spiders, worms, corrupted files, or any other similar software or materials that may damage, interfere with, disrupt, impair, disable or otherwise overburden the operation of any device, computer system or network; or other harmful, or disruptive codes, components or devices
  • Is off-topic, meaningless, or otherwise intended to annoy or interfere with others’ use of the Site/Service
  • Uses scripts, bots or other automated technology to access the Site/Service
  • Violates the rights of third parties, including rights of copyright, patent, trademark, trade secret or other propriety right or rights of publicity or privacy
  • Violates any law, statute, ordinance, or regulation, including but not limited to, those governing export control, consumer protection, unfair competition, anti-discrimination, false advertising or the provision of child care, elder care or health care JobsBoard may but has no obligation to, monitor user content submitted on the Site/Service, including User profiles, ratings or other content. We may remove any such information, and material that in our sole opinion either violates, or may violate, any applicable law or either the letter or spirit of these Terms and Conditions; might be offensive, illegal or that might violate the rights, harm, or threaten the safety of Users or others; or is determined to be inappropriate for any other reason at the sole discretion of JobsBoard.
By posting content to JobsBoard, Users represent and warrant that they have the right to post and transmit the information being shared. JobsBoard reserves the right to use, copy, display, reproduce, adapt, modify, and distribute User information and content posted or transmitted on the Site/Service and to prepare derivative works of, or incorporate into other works, such information and content, and to grant and authorize sublicenses of the information shared.

Users of JobsBoard may have the opportunity to rate each other after they have worked together. Ratings will not include any personal information about either party. Ratings should be limited to factual information based upon the Users’ experience working together and not include broad generalizations or exaggerations. Ratings should be updated to reflect the most current experience with other Users. As with all Site/Service content, JobsBoard reserves the right to remove any rating that violates these guidelines.

Links to Third Party Websites
The Site/Service may contain links to third party websites solely for convenience. Customer understands and agrees that JobsBoard does not control or endorse such third party websites or any products, services, or advertisements that are made available by such third parties. Customer understands and agrees that use of such third party websites is at Customer’s own risk, that such third party websites are governed by such third party’s terms of use and privacy policies, and that JobsBoard is not responsible for the privacy practices or other policies of such third party websites. Customer agrees that JobsBoard is not liable for any controversies, causes of actions, claims, lawsuits, injuries and/or damages, arising from and/or in any way related to such third party websites, including without limitation such websites’ availability, terms of use, privacy policy, information, content, materials, advertising, products and/or services.
The content on this website, including all proprietary information, is provided “as is” and JobsBoard does not warrant the accuracy or integrity of the information contained therein, whether express or implied, with respect to the services provided. JobsBoard does not warrant that the Customer’s use of the services will be secure, uninterrupted, error free, or will meet User requirements. JobsBoard disclaims liability for the suitability of any Customer or Client, including without limitation, participants in any third party service offered on our Site/Service
Payment and Refund Policies
Where indicated, Users are charged fees to utilize JobsBoard. Fees are based upon the type of membership a User signs up for and the fees that are currently in effect at the time of purchase. Click here for a listing of all fees associated with this Site/Service. Fees are subject to change and will affect new Users, not Users who have active memberships during the time of the change. If a User’s subscription has lapsed and fees change, when those Users re-enroll, they are subject to the most current rate. While use of the Site/Service may be free for individual care providers, some services, including without limitation consumer reports, may be offered for a fee. JobsBoard may offer promotions, such as limited-time, free trial memberships. If Customer continues his or her membership after the end of the promotional period (e.g., after the free-trial period expires), Customer will be charged for a monthly membership to the Site/Service at the price then in effect. To avoid such charges, Customers must cancel their membership prior to the end of the promotional period (e.g., before the free-trial period expires).
Users may cancel their account at any time by emailing JobsBoard administrators at
[email protected]. Cancelling a User account does not guarantee a refund. If Users are cancelling their account and would like a refund, a formal request must be sent to [email protected].

Customer authorizes JobsBoard to charge its chosen payment provider in connection therewith. JobsBoard reserves the right to correct any payment errors even if it has already requested and/or received payment. JobsBoard may use third party payment processing services for processing credit card information. JobsBoard uses commercially reasonable efforts to protect the privacy of Customers’ personal and financial information. Nevertheless, JobsBoard expressly disclaims any and all liability whatsoever for any controversies, causes of action, claims, lawsuits, injuries and/or damages, arising from and/or in any way related to JobsBoard‘s use of third party payment processing services, including without limitation any liability for any such information released to any third parties. For further information about JobsBoard use of payment processing services, please contact JobsBoard by email at [email protected]. JobsBoard may offer limited-time, free trial memberships or other promotions from time to time. If Customers continue their membership after the end of the free trial or promotional period, Customers will be charged the price then in effect for a monthly membership to the Site/Service. To avoid such charges, Customers with free trial or promotional memberships must cancel their membership before the end of the free trial or promotional period.
Limits of Liability JobsBoard provides its Site/Service “as is” and on an “as available” basis. Use of this Site/Service is at the User’s own discretion and risk. JobsBoard grants no warranties of any kind, whether expressed or implied, statutory or otherwise with respect to the Users, the services provided, the Site/Service itself, or any information contained within the Site/Service. JobsBoard does not grant any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. JobsBoard does not warrant the accuracy, adequacy or completeness of any information or materials on the Site/Service. JobsBoard does not warrant that use of the Site/Service or the information contained within the Site/Service will be secure, uninterrupted, error-free, available, accurate, or that any defects in the Site/Service will be corrected. JobsBoard makes no warranties about the connectivity and continued availability of the Site/Service.

Users agree to release JobsBoard, Suite Business Services, LLC and their affiliated parties from any claims, demands, damages, liability, costs, or expenses of every kind and nature, known or unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with any claim or controversy that may arise from any disputes between Users. JobsBoard makes no claims or promises about the opinions, advice, statements, reviews, or other information or content made available on the Site/Service or through the services and agreements between Users.

In no event will JobsBoard, Suite Business Services, LLC or their affiliated parties be liable for any damages whatsoever, whether direct or indirect, general, special, compensatory, consequential, and/or incidental, arising out of or relating to the conduct of Users or anyone else in connection with the use of the Site/Service, including without limitation, bodily injury, emotional distress, and/or any other damages resulting from interactions with other Users of the Site/Service, regardless of whether interactions occur online or offline, Users’ reliance on information or other content available on the Site/Service or transmitted between Users and reviews or comments made about Users on the Site/Service by other Users.

Users agree that JobsBoard, Suite Business Services, LLC and their affiliated parties have no liability for any indirect, special, incidental, or consequential damages; loss of profits; business interruption; loss of or damage to reputation; or loss of information or data. JobsBoard‘s maximum aggregate liability to Users for losses or damages suffered in connection with the Site/Service, or these terms of service is limited to the greater of the amount paid, if any, by the User to JobsBoard in connection with the Site/Service in the 12 months prior to the action giving rise to the liability or $100, whichever is more.

Users only right and remedy in the case of dissatisfaction with the Site/Service or any other grievance shall be the termination of their account and discontinuation of access to, or use of the Site/Service.

Digital Millennium Copyright Act JobsBoard respects the intellectual property rights of others and expects its Users to do the same. JobsBoard may remove content that, in its sole discretion, appears to infringe the intellectual property rights of others, including Users and non-Users of the Site/Service. In addition, JobsBoard, in its sole and absolute discretion, may terminate the accounts of Users who infringe the intellectual property rights of others. If Users believe any materials on the Site/Service infringe the copyrights of others, they may request removal of those materials from the Site/Service by contacting JobsBoard at [email protected] and providing the following information:

  • A copy or the location of the copyrighted work believed to have been infringed upon
  • A copy or the location of the material believed to be infringing upon the copyrighted work
  • Name, address, telephone number and (if available) email address of the person reporting the potential issue along with a statement indicating that “under penalty of perjury,” the person reporting the issue is the copyright owner or is authorized to act on the copyright owner’s behalf
  • A good faith statement that explains why the User believes that use of the material is not authorized by the copyright owner, its agent or the law
  • A statement that the information supplied is accurate
  • A signature or the electronic equivalent from the copyright holder or authorized representative
