iPad Mini and Visa Giftcard Giveaway Official Rules

  1. No purchase is necessary to enter or win. All federal, state, local and municipal laws and regulations apply. Void where prohibited. Promotion period begins on Friday, March 22, 2013 and ends at 11:59pm, Wednesday May 1st, 2013. All eligible entries will be entered into the Promotion. Entries submitted before or after the beginning and end of the stated promotion times will be disqualified. Odds of winning depend on the number of valid entries received.
  2. Agreement to official rules. By participating in the iPad Mini Giveaway (also referred to as the "Promotion"), entrant fully agrees to and accepts these official rules and the decisions of HireMyCare.com (also referred to as the "Sponsor") which are final and binding in all respects. Failure to comply with the official rules will result in disqualification from the Promotion and forfeiture of any prize or of the right to any prize.
  3. Eligibility. iPad Mini Giveaway is open to legal US residents in Oklahoma, Georgia, and Louisiana who are 18 years or older at the time of entry. Directors, officers, employees and members of employees' households and immediate family (spouses, parents, siblings, children, and each of their respective spouses) of Acumen Fiscal Agent LLC, HireMyCare.com, and all other LJV companies are ineligible to enter the Promotion. All entrants must meet all eligibility requirements. A potential winner may be requested to provide the Sponsor with proof of identity.
  4. Methods of entry. To receive automatic entry into the Giveaway: (1) new HireMyCare.com Caregivers or Vendors must (a) register online at hiremycare.com to receive access to HireMyCare.com and (b) receive initial confirmation/receipt email from Sponsor or; (2) current HireMyCare.com Caregivers and Vendors must have a current valid email address listed in their account. Limit: One (1) entry per person. In the event of a dispute as to the identity of a winning entry, the entry will be deemed made by the "Authorized Account Holder" of the email address associated with the winning entry. The "Authorized Account Holder" is defined as the natural person to whom the applicable Internet service provider or other organization (such as business or education institution) has assigned the email address for the domain associated with the submitted email address. Sponsor reserves all legal rights to pursue legal action against any entrant that fraudulently enters multiple times and/or creates "fake" profiles.
  5. Selection of Winner. Winner will be selected by random drawing of all the valid entries received by no later than Wednesday, May 1st, 2013 at 11:59PM. Winners will be notified by email. If a winner is unreachable after seven (7) days, or if that winner is unavailable for prize fulfillment, an alternate winner will be selected. If HireMyCare.com cannot find an eligible winner for the prize, that prize will not be awarded.
  6. Prizes. The Winner will receive the Grand Prize, which consists of and is limited to: 16GB Black & Slate iPad Mini with Wi-Fi capability, valued at $329. The prize must be accepted as awarded, and is not transferable or substitutable for the monetary value of the prize. The prize is awarded "AS IS" with no warranty, representation, or guarantee, express or implied. All expenses and costs associated with the prize not expressly stated or described above are the responsibility solely of the winner. Prize is non-transferable and no substitutions or cash equivalents permitted, except by Sponsor who reserves the right to substitute a prize of comparable or greater value, at its sole discretion. Eight secondary prizes of a $25Visa card will be awarded, and will be chosen randomly each week from Caregivers and Vendors who have signed up on HireMyCare.com from 12:00am EST March 22, 2013 to 11:59pm May 1, 2013. Two secondary prizes will be awarded for 4 consecutive weeks beginning Monday, April 8th, 2013. One caregiver and one vendor will be randomly selected from those that registered within the previous seven days in the applicable states before the following selection dates: 4/8/2013, 4/15/2013, 4/22/2013, 4/29/13.
  7. Tax Liability. Prize recipient agrees to pay all applicable federal, state, and local taxes associated with the award of the prize, including income tax, and all other taxes, costs, fees and expenses related to the prizes. Prize winner should consult with his or her tax advisor with respect to the tax consequences associated with winning a prize.
  8. Winners List. The name of the Winner will be posted online at facebook.com/hiremycare after the prize has been awarded and HireMyCare.com staff will begin notifying the winners via email and/or phone by 8pm EST the following day after the winner is selected. Once contacted, award recipients will be required to provide their mailing address so that prizes may be shipped and delivery confirmed.
  9. Publicity. Prize winner agrees to provide and to grant HireMyCare.com the absolute right and permission to use the prize winner's name, likeness, voice, opinions, biographical information, and address in any and all advertising and promotional materials, in any manner or media whatsoever, for purposes of advertising, trade or promotion.  The prize winner acknowledges and agrees that he/she shall have no right of approval, no claim to any compensation for, and no claim arising out of the use of, his or her name, address, personal information, photograph or likeness.
  10. General Conditions. By participating in the Promotion, entrants agree to comply with and to be bound by the official rules and by all interpretations of the official rules by the Sponsor. Decisions of HireMyCare.com shall be final in all matters relating to the Promotion. The HireMyCare.com reserves the right to modify, suspend, or cancel the Promotion if fraud, technical failures, or any other factor beyond HireMyCare.com's reasonable control impairs the integrity of the Promotion and the integrity of the selection of the prize winners as determined by HireMyCare.com in its sole discretion.
  11. Release of Liability. By entering the Promotion, all entrants agree to release and hold harmless the Sponsor and its affiliates, parent companies, subsidiaries, officers, directors, employees and members, from and against any claim or cause of action arising in connection with each entrant's participation and/or entry in the Promotion and/or their receipt or use of any prize awarded in this Promotion. HireMyCare.com shall not be liable to the contest participant, prize winner, or any other user or third party for any direct, indirect, incidental, consequential, special, punitive or exemplary damages. Notwithstanding anything herein to the contrary, the aggregate liability of HireMyCare.com to any contest participant or prize winner will not exceed the total value of the contest grand prize based on the event giving rise to the claim or cause of action under the terms and condition or for any special, indirect, or consequential damages, including without limitation, lost business or lost profits, whether foreseeable or not, even if such party has been advised of the possibility of such damages arising out of or in connection with the performance or non-performance under these terms and conditions.
  12. Sponsor. The Promotion is sponsored by the HireMyCare.com and its associated company Acumen Fiscal Agent LLC, whose decisions regarding the selection of Winner and all other aspects of the Promotion shall be final and binding on all persons in all respects. The Sponsor is not responsible for typographical, printing or other inadvertent errors in these Official Rules or in other materials relating to the Promotion.   13. Disputes. Except where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Arizona and entrant hereby submits to the jurisdiction thereof. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant's rights and obligations, or the rights and obligations of the Sponsors in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Arizona, without giving effect to any choice of law or conflict of law rules (whether of the State of Arizona or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Arizona.
